Please note: These terms and conditions are not valid when you purchase one of our apps at Google Play, Apple's AppStore (iOS/Mac OS) or Microsoft's Marketplace. In this case please refer to their terms and conditions.

§1.    Applicable law

(1) Court of jurisdiction is Ravensburg.
(2) German law applies under exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG)

 

§2.    Limitation of liability and warranty for chargeable software

(1) Title to compensation for damages - not to life, limb or health - exists only if the ageye-GbR is accused for intention or gross negligence.
(2) If someone already knows a defect according to § 434 paragraph 1 German Civil Code (BGB) before the contract is concluded, he may not make use of his warranty rights according to § 442 BGB.
(3) According to § 434 paragraph 1 sentence 1 BGB, only the software functionality which is published on the homepage of ageye-GbR is available.
(4) Updates of the software are not part of the act of sale. There is neither a claim for the availability of software updates nor are they, in case of their availability, subject of the warranty rights of the purchased software.
(5) The right of withdrawal according to § 312d paragraph 4 no. 2 BGB is excluded after receiving the license key.

 

§2.1.    Additional limitation of liability and warranty for G-Weather

(1) G-Weather is designed to show the weather data from www.wetter.com and is therefore only an interface for the data retrieval from www.wetter.com
(2) ageye GbR is not liable if the data is not available for a short or long time due to technical problems of wetter.com (e.g. server break-down) or due to other reasons (e.g. termination of the agreement between ageye GbR and wetter.com)

 

§3.    Limitation of liability and warranty for non-chargeable software

(1) There is no warranty for free software.
(2) The ageye-GbR is only liable for malice and intention according to §§ 524, 276 paragraph 3 BGB
